 JUNE 20, 2013 – The Amended 1987 Haitian Constitution has not settled the issue of double nationality. Recently, Senator John Joel Joseph of Port-Au-Prince questioned the nationality of many government members, including the Minister of Haitian Living aboard, the Minister of Sports and the Minister of Tourism. According to Senator Joseph, those ministers are headed by foreigners – Haitians who possess foreign passports. From France to Dominican Republic, from Canada to Turks and Caicos, the Haitian Diaspora is very concerned about its apparent inability to contribute to the development of Haiti. According to Article 172 of the Haitian Constitution, Haitians who possess foreign passports are unable to serve as Ministers, Senators, Deputies, and ambassadors. However, the same constitution recognizes the right of those same Haitians to vote in elections where they cannot be candidates or serve as government bureaucrats.

 The apparent confusion and application of the law have caused serious concerns to many in the diaspora who are wondering whether Haiti can really develop without the tremendous resources and human potential of its Diaspora. Many countries in the Caribbean and other places around the world have recognized the importance of their diaspora, and have actively implemented policies to include and integrate their diaspora in the affairs of their governments. Why not Haiti? Why is Haiti afraid of its Diaspora? Do we need a constitutional revision to ensure that the Diaspora is fully integrated into Haiti? Do we need to exempt the Minister of Haitians Living Aboard from such constitutional requirements? Should the Minister of the Diaspora be someone who has lived in the diaspora? Should this Ministry be positioned outside of Haiti? Should this minister be funded by the diaspora? Our panelists of lawyers, legislators, community organizers and professionals will debate these questions and others.
